SKDC Licensing Act 2003 Policy
The Licensing Act 2003 requires a local authority to have in place a Statement of Licensing Policy this is effective as of January 2011.
Section 5 of the Licensing Act 2003 requires a licensing authority to determine and publish a statement of its licensing policy at least once every five years.
SKDC reviewed the current policy between 27 August 2010 and 19 November 2010 and the policy was adopted on 6 January 2011.
Licensing authorities are exercising a discretionary power and are not entitled to adopt a policy that allows them to dispose of cases before them without any consideration of the merits of the individual applications.
This licensing policy however is intended to provide clarity to applicants, interested parties and responsible authorities on how this authority will determine applications
